John Lauro, Trump’s attorney, made a similar suggestion on CBS Mornings, Wednesday, when he said that the court should be located in West Virginia, a state he described as the “political opposition to Washington, DC.” In the 2020 Presidential ElectionBiden received 92 percent of the vote in District of Columbia, while Trump only got 69 percent.
Legal experts told Insider that a federal court would not grant the request.
“The case against Trump is so strong, I don’t think that this would be the right jurisdictional limit in any court anywhere in the universe or galaxy,” said Norm Eizen, a senior Fellow at the Brookings Institute and co-counsel in the first impeachment proceedings. “I don’t have any concerns about the defendant getting a fair trial, even if political gains are made out of it,” said Eisen. This defendant is going to make political trouble no matter what, with the help of his enablers, supporters, and other people who will support him.
Goodman, who is a professor of law at New York University School of Law, agrees with Eisen. He says that the legal theories used by Trump and his lawyer to move the case from Washington, DC are “really bad,” and “not really a valid legal argument.”
Goodman told Insider: “I don’t think it is conceivable that the courts would decide that the case be heard in another jurisdiction.” “The arguments made by them are not legal arguments.”
