Katherine Feinstein, the daughter of Democratic Sen. Dianne Feinstein, is a former San Francisco Judge. She has a Power of Attorney agreement which gives her some control over Dianne’s affairs.

Katherine Feinstein filed a lawsuit against the trust for the late senator Richard Blum. She is now the San Francisco fire commissioner. In the court filing, Feinstein identified as the “attorney en fact” of the Democratic lawmaker. The agreement permitted the former judge, who was also a judge at the time of the lawsuit, to represent her mother.

There is no way to know how much power Feinstein has over the 90-year old lawmaker.

A power of attorney may not be granted if the person is unable or unwilling to make their decisions. The Los Angeles Times has previously reportedIn cases of convenience, a limited-power of attorney can be granted. Planning for an agreement is still considered to be a significant part of estate planning.

Another important reason for using a power of attorney is preparing yourself in case you are unable to act on behalf of yourself due to illness or absence. The American Bar Association states. “An impairment of this kind may be temporary due to an accident or illness or may be permanent, such as a result of travel.”

Katherine Feinstein signed a lawsuit on behalf of Sen. Dianne Feinstein. This shows that there was some type of power-of-attorney agreement.

The New York Times reported on Blum’s fight for Blum Trust in great detail. reportedKatherine Feinstein has “power of attorney” over the legal affairs of her mother. A spokesperson for Feinstein’s Senate office didn’t immediately respond to an inquiry for comment.

Sen. Feinstein was asked to resign as a Senator due to the persistent questioning of her ability to serve fully. Feinstein missed three months worth of congressional meetings in Washington, D.C. after she contracted shingles. She also has multiple episodes in which it appeared that she was confused and unaware of the events taking place. The Senate Judiciary Committee heard about this issue recently.

Katherine Feinstein’s suit cited “significant” medical expenses her mother had incurred. Katherine Feinstein wants to replace her mother as sole trustee. The Feinsteins claim that Blum’s two associates, who are acting in the capacity of trustees, have refused to reimburse Feinstein for her medical expenses.

Steven P. Braccini is an attorney representing Mark R. Klein, Marc Scholvinck and the trust. He previously stated that this request had not been denied. Braccini raised questions about whether a power-of-attorney agreement existed.

“We haven’t been shown any evidence that Katherine Feinstein is a power of lawyer for her mother. Nor has Katherine explained to my clients or in the filing why a senator sitting at senate would need someone to be her power of attorney,” Braccini made the statement in July to Associated Press. 

Health scares for both McConnell, and McConnell himself have re-ignited the debate over whether Congress should impose age restrictions. Feinstein pledged that she would retire at the conclusion of her current tenure, but has refused to resign.
